Hi, this is Ray Kerlick from the Law Firm of Wadler, Perches, Hundl and Kerlick. I’m here in our Fulshear office to talk a little bit about estate planning for our college-age kids. Now, most of us think that seems a little odd to be worried about estate planning for a young person, but realize that what we’re really doing is preparing for worst case scenarios. And so, for most of us what we need to recognize is once our children reach the age of 18, their rights and obligations are theirs, and you have very limited ability to take care of things for them, legally, once they reach the age of 18.

Statutory Durable Power of Attorney
As your child is going off to college, leaving home for the first time, what we would recommend is entering into a statutory durable power of attorney for that child. The statutory durable power of attorney allows you to make certain legal and financial decisions for them, if for some reason they cannot or are unable to do so.
Medical Power of Attorney
Another component of our College Kid Packages is a medical power of attorney that will allow them to allow you to make medical decisions for them, if they end up, for example, in the university hospital. That way, you are authorized to interact with that medical team caring for your child.
Health Insurance Portability and Accountability Act (HIPAA) Authorization
Likewise, we recommend a HIPAA authorization, which could allow you to receive medical information and view medical records for your adult child.
FERPA Document
Finally, a FERPA (Family Educational Rights and Privacy Act) document is another component of our College Kid Package that we would recommend and prepare. That is the document that most parents are interested in because it allows you access your child’s academic records, including the transcripts, grade points, and class listings. You’ll be able to access the types of documents that allow you to monitor the university enrollment of your child. In many cases you are paying for that college education and the FERPA document allows you to check on that investment in your child.
